Welcome to the Easy Tee website and services. Please read these Terms of Use carefully. By accessing or using our website and services, you agree to be bound by these terms. If you do not agree, please leave the website now.

Easy Tee may update these Terms from time to time. Your continued use of our website and services constitutes acceptance of any updated terms. It is your responsibility to check for changes between visits.

1. Our Services

Easy Tee provides the following services:

Create, design, and customise products listed for sale
Purchase products listed for sale
Save and share designs you have created
Use our design and image tools
Save images and designs to public and personal galleries
Post created images to social networks or blogs where you have the legal right to do so
Register to subscribe to special offers and gallery access

2. Using Our Services

2.1 Eligibility

Easy Tee provides products and services only to persons who can lawfully enter into and form contracts under applicable law.

If you are under the age of 18 but at least 13, you may only order products or services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
Children under 13 may view the website but may not order products or services.

2.2 Definitions

In these Terms of Use, unless the context indicates otherwise:

Intellectual Property Rights means all industrial, commercial and intellectual property rights (including equivalent, neighbouring or proximate rights anywhere in the world that currently exist or are recognised in the future).
A person means any form of legal entity as well as any quasi-legal entity.
A User means any person using the website and/or services provided by Easy Tee.
A reference to any document, material, information or data includes that document, material, information and data howsoever stored, recorded or embodied, including in any electronic or digital media.
The word includes in any form is not a word of limitation.

3. User Obligations

3.1 Responsibilities

Users are solely and exclusively responsible, at their own cost, for:

All telecommunications and hardware necessary to access and use the website and services
The use they make of the website, including any content they create, author or produce
Complying with all laws, regulations and rules in their country or jurisdiction
Complying with any recommendations or guidelines issued by Easy Tee with respect to use of the website and/or services
Ensuring all media used in connection with the website and services complies with these Terms and all applicable laws

3.2 Restrictions

Users shall not:

Reproduce, publish, distribute, sub-licence or resell the website and/or services
Modify, adapt, disassemble, recompile or reverse engineer the website or services
Access or use the website or services to create, design, publish or distribute content that:
- Infringes any person's Intellectual Property Rights, trade secrets, privacy or publicity rights
- Is defamatory, libellous or slanderous
- Contains or links to adware, malware, hacks or similar programs
- Contains explicit sexual content
- Denigrates or offends any ethnic, racial, gender, religious or other group
- Harasses, threatens or abuses others
- Exploits images or likeness of minors
- Encourages the use of drugs or underage use of alcohol or cigarettes
- Is generally offensive or in bad taste
Use spam or unsolicited communications to market products or services
Introduce viruses or any programs that disrupt or damage the website or services
Impose unreasonable or disproportionately large loads on the website or services
Use automated tools to monitor or copy pages from the website
Impersonate another person or entity
Assist or procure any person to engage in any prohibited activity
Frame or link the website so that it appears to be part of another website without express agreement

Easy Tee may, in its sole discretion, immediately terminate these Terms, disable access, and take legal action against any user who engages in prohibited conduct.

4. Easy Tee Obligations

4.1 Access to Services

Subject to users complying with these Terms, Easy Tee will allow users to access and use the website and services.

4.2 Privacy

Easy Tee may collect personal data in the course of your use of the website and services. Easy Tee will handle such data in accordance with its Privacy Policy, accessible via the website, and in compliance with the Australian Privacy Act 1988.

4.3 Training

Easy Tee has no obligation to provide training or support in relation to the use or operation of the website and/or services.

4.4 Modification of the Website

Easy Tee reserves the right to modify the organisation, structure, content or appearance of the website and/or services, and may change, suspend or discontinue any aspect at any time without notice or liability.

5. Intellectual Property Rights

5.1 Reservation of Title

These Terms do not convey any right, title or interest in any Intellectual Property Rights that vest in or relate to the website and/or services. Easy Tee grants users a limited, revocable licence to access and use the website for its intended purposes, subject to compliance with these Terms. This licence does not include the right to collect or use information from the website for unauthorised purposes, create derivative works based on the website's design, or download or copy the website (other than page caching).

5.2 Prohibition on Infringement

Users acknowledge and agree that Easy Tee expressly prohibits use of the website or services in any manner that infringes, or is likely to infringe, the Intellectual Property Rights or any other rights of any person anywhere in the world.

5.3 User-Created Material

Subject to clause 5.2, users own any Intellectual Property Rights in original material they create using the website. If a user adds content to a public gallery, they grant Easy Tee an irrevocable, perpetual, non-exclusive, worldwide licence to use that material.

6. Registration

Upon completing registration, you will receive an account and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to:

Immediately notify Easy Tee of any unauthorised use of your account or any breach of security
Ensure you exit your account at the end of each session

Easy Tee is not liable for any loss or damage arising from your failure to comply with these obligations.

7. Warranties

7.1 User Warranties

Users represent and warrant that their use of the website and services:

Will not infringe any person's Intellectual Property Rights, trade secrets, privacy or publicity rights
Will comply with all applicable laws, rules and regulations

Users further represent and warrant that:

There are no claims or litigation pending or threatened with respect to any content they use
Easy Tee will not be required to make any payments to any person in connection with the user's content
Such content does not contain viruses or programs that would damage the website or services

7.2 Easy Tee Warranties

Easy Tee represents and warrants that it has the right to grant access to and licence the use of the website and services subject to these Terms.

7.3 Caveats

Easy Tee provides the website and services on an "as is" and "as available" basis. Easy Tee does not warrant that:

The website and services will be uninterrupted or free of errors
The website and services will meet users' specific requirements
The website and services will operate with any particular hardware or software configuration

Easy Tee does not control the flow of data through the internet and is not liable for disruptions caused by third parties or infrastructure outside its control.

7.4 Exclusion of Implied Warranties

Subject only to clause 8.1 and the Australian Consumer Law, all conditions, warranties, representations, indemnities and guarantees with respect to the website and services that would otherwise be implied by statute, law, equity, trade custom or prior dealings are expressly excluded to the maximum extent permitted by law.

7.5 No Representation or Reliance

Users acknowledge that no representation or inducement has been made to enter into these Terms other than as expressly set out herein.

8. Exclusion and Limitation of Liability

8.1 Subject to Law

Nothing in these Terms excludes, restricts, limits or modifies any:

Implied condition, warranty or other term where to do so would be unlawful under applicable law
Liability for breach of these Terms where to do so would be unlawful
Liability for fraud or deceit
Liability for death or personal injury caused by negligence
Rights under the Australian Consumer Law that cannot be excluded

8.2 Exclusion of Liability

Subject to clause 8.1, Easy Tee is not liable for:

Malfunctions, failures or defaults caused directly or indirectly by third parties, user misuse, unauthorised modification, force majeure, or other conditions outside normal operating conditions
Any loss, cost, damage or expense arising from a user's breach of these Terms
Any loss of profit, business interruption, loss of goodwill or expectation benefit
Incidental, indirect, consequential, special, exemplary or punitive damages of any nature

8.3 Links

Easy Tee may place links on the website to third-party websites. Easy Tee is not responsible for the operation or content of any linked website and cannot warrant that such content is accurate, complete, legal or inoffensive.

8.4 Limitation of Liability

Subject to clause 8.1, Easy Tee's sole liability for any breach of these Terms shall be limited to the substitution or replacement of any product or service ordered and paid for by the user.

8.5 Indemnity

Users shall indemnify Easy Tee against any liability, loss, cost, expense or damage (including legal fees) arising from: (a) their use of the website and services; (b) any breach of these Terms; (c) misuse of content or media; or (d) any infringement of any person's Intellectual Property Rights or other rights anywhere in the world.

9. Termination

9.1 Termination

Easy Tee may immediately terminate these Terms or suspend any user's access at any time, with or without cause, without liability. Termination does not relieve users of obligations accrued prior to termination. Users may terminate these Terms at any time by ceasing to use the website and services.

9.2 Effect of Termination

On termination, Easy Tee may delete any content or material relating to a user's use of the website and services without liability. Termination does not prejudice any accrued rights or remedies of either party.

10. General

10.1 Severability

If any clause or part of any clause of these Terms is found to be void, invalid or unenforceable, it shall be read down or severed to the minimum extent necessary. This does not affect the validity or enforceability of the remaining terms.

10.2 Variation

Easy Tee may amend these Terms at any time in its sole discretion. Amended terms are effective immediately upon being posted on the website. Continued use of the website constitutes acceptance of amended terms. If you do not agree to any amendments, your only remedy is to cease using the website and services.

10.3 Waiver

A waiver, consent or acquiescence given by either party is only effective and binding if given or confirmed in writing.

10.4 Assignment

Easy Tee may at any time transfer, assign, novate or otherwise dispose of any or all of its rights or obligations under these Terms on giving no less than five (5) days written notice to the user.

10.5 Governing Law and Jurisdiction

(a) These Terms of Use shall be governed by and construed in accordance with the laws of New South Wales, Australia.

(b) Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales, and the courts competent to determine appeals from those courts, with respect to any proceedings that may be brought at any time relating to these Terms of Use.

11. Returns Policy

11.1 Our Guarantee

Easy Tee stands behind the quality of every garment and print we produce. Prints are designed to last the lifetime of the garment. If your order arrives with a defect in printing or garment construction, contact us within 30 days of purchase and we will refund the full product price. Postage and processing costs are excluded. Nothing in this policy limits any rights you may have under the Australian Consumer Law.

11.2 Exclusions

Easy Tee does not accept returns or offer refunds in the following circumstances:

Garments that have been worn, hot washed, or tumble dried
Garments damaged through bleaching, fabric softener, dry cleaning, or ironing on the print surface
Errors in artwork, spelling, or design caused by the customer — Easy Tee prints exactly what the customer submits and takes no responsibility for the accuracy of customer-created designs
Incorrect options selected by the customer, such as product type or size
Damage deliberately caused to facilitate a return

11.3 Damaged in Transit

If your order arrives damaged, do not sign for the delivery. Photograph the package before opening it, then contact us at returns@easytee.com.au to obtain an RMA number before returning anything. Returns without an RMA number will not be accepted.
